My name is James Carter, and I’m the attorney at Hunter Law that specializes in handling those cases that can arise as a result of the grievous transition between life and death. In addition to having the honor of being an attorney here at Hunter Law, I am also the third-generation owner of a prominent local funeral home. I personally lost my father unexpectedly as a result of a supposedly simple orthopedic procedure – which ended up leaving him with permanent brain damage and on indefinite life support. I have experienced and endured the process of Wrongful Death and Medical Malpractice litigation not only as an attorney, but as a victim and plaintiff as well, so I am completely aware of and prepared to help you as you navigate these treacherous emotional and legal waters.
It is incredibly hard to make important decisions while you are grieving – the best way is to create an incapacity plan in advance and appoint an agent to act for you if you are temporarily impaired. This can make all the difference in peace of mind of your loved ones while they are attempting to process the experience of your infirmity and conduct your affairs while you recover. In the event that you cannot make an informed decision about important health care decisions, it is of paramount importance to appoint an agent with statutory access to your health information in accordance with HIPAA, who can inform your health care provider of your wishes made known in advance, or can make those decisions for you. I can personally attest that handling these issues in advance allowed my family to enact significant corporate, real estate, and financial transactions prior to removing my father from life support, which made the process of probating his estate much easier on the executor and far less costly.
Of course, an inconvenient truth is that we are all going to die.
